With the following privacy policy, we inform you about the scope and use of your personal data that we collect and process as part of our website. In addition, we tell you the purpose for which we collect and process the data and what rights you have concerning data protection under the European General Data Protection Regulation.

2. COLLECTION AND STORAGE OF PERSONAL DATA AND THE NATURE AND PURPOSE OF THEIR USE2.1 WHEN VISITING THE WEBSITE

2.1 WHEN VISITING THE WEBSITE

When you visit our website https://www.xlifesciences.ch/, information is automatically sent to our website's server by the browser used on your device. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • Browser used and, if applicable, your computer's operating system and the name of your access provider.

The above data is processed by us for the following purposes:

  • Ensuring a smooth connection setup of the website,
  • Ensuring comfortable use of our website,
  • Evaluation of system security and stability, and
  • For further administrative purposes.

The legal basis for data processing is Art. 6 Paragraph 1 S. 1 lit. f GDPR. Our legitimate interest follows from the purposes listed above for data collection. We never use the collected data to draw conclusions about your person.

In addition, when visiting our website, we use cookies and analysis services and plug-ins.

2.1.1. COOKIES

We use cookies on our site. These are small files that your browser automatically creates and are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not harm your device and do not contain viruses, Trojans, or other malicious software.

The cookie stores information related to the specific device used. However, this does not mean that we are immediately aware of your identity.

The use of cookies serves to make the use of our offer more pleasant for you. We use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically deleted after leaving our site.

We also use temporary cookies to optimize user-friendliness, which are stored on your device for a specific period. 2.1.2. ANALYSIS-/TRACKING-TOOLS
2.1.2.1. GOOGLE ANALYTICS

For the purpose of the needs-based design and continuous optimization of our pages, we use Google Analytics, a web analysis service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, pseudonymized usage profiles are created, and cookies are used (see under No. 2.1.1). The information generated by the cookie about your use of this website, such as

  • Browser type/version,
  • Operating system used,
  • Referrer URL (the previously visited page),
  • Hostname of the accessing computer (IP address),
  • Time of the server request,

are transferred to a server of Google in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activities, and to provide other services related to website use and internet use for market research purposes and to tailor these internet pages to requirements. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized, so that an assignment is not possible (IP masking).

You can prevent the installation of cookies by setting the browser software accordingly; however, we would like to point out that in this case, not all functions of this website can be used in full.

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on.

2.1.3. PLUG-INS

We use plug-ins on our website.

2.1.3.1. YOUTUBE

Our website uses plugins from the Google-operated site YouTube. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages equipped with a YouTube plugin, a connection is made to the YouTube servers. This tells the Youtube server which of our pages you have visited.

If you are logged into your YouTube account, you allow YouTube to associate your surfing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

2.1.3.2. TWITTER

On our websites, plugins of the short message network of Twitter Inc. (Twitter) are integrated. You can recognize the Twitter plugins (tweet button) by the Twitter logo on our page. An overview of tweet buttons can be found here. When you visit a page of our web presence that contains such a plugin, a direct connection is established between your browser and the Twitter server. Twitter thus receives information that you have visited our page with your IP address. If you click the Twitter "tweet button" while you are logged into your Twitter account, you can link the contents of our pages to your Twitter profile. This allows Twitter to associate the visit to our pages with your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the data transmitted or of its use by Twitter. If you do not want Twitter to be able to associate the visit to our pages, please log out of your Twitter user account. 2.1.3.3. INSTAGRAM

On our website, so-called social plugins ("plugins") from Instagram are also used, which are operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA ("Instagram"). The plugins are marked with an Instagram logo, for example in the form of an "Instagram camera." When you visit a page of our web presence that contains such a plugin, your browser establishes a direct connection to the servers of Instagram. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. Through this integration, Instagram receives information that your browser has called up the corresponding page of our web presence, even if you do not have an Instagram profile or are not currently logged in to Instagram. This information (including your IP address) is sent from your browser directly to a server of Instagram in the USA and stored there. If you are logged in to Instagram, Instagram can directly associate the visit to our website with your Instagram account. If you interact with the plugins, such as pressing the "Instagram" button, this information is also transmitted directly to a server of Instagram and stored there. The information is also published on your Instagram account and displayed to your contacts. If you do not want Instagram to directly associate the data collected via our web presence with your Instagram account, you must log out of Instagram before visiting our website. 2.1.3.3. HUBSPOT CRM

We use Hubspot CRM on this website. The provider is Hubspot Inc., 25 Street, Cambridge, MA 02141 USA (hereinafter Hubspot CRM).

Hubspot CRM enables us, among other things, to manage existing and potential customers and customer contacts. With the help of Hubspot CRM, we are able to capture, sort, and analyze customer interactions via email, social media, or phone across different channels. The personal data collected in this way can be evaluated and used for communication with the potential customer or for marketing measures (e.g. newsletter mailings). With Hubspot CRM, we are further able to record and analyze the user behavior of our contacts on our website.

The use of Hubspot CRM is based on Art. 6 (1) lit. f GDPR. The website operator has a legitimate interest in the most efficient customer management and customer communication possible. Insofar as a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.

2.2. WHEN USING OUR CONTACT FORM

If you have any questions of any kind, we offer you the opportunity to contact us using a form provided on the website. It is necessary to provide your first and last name as well as a valid email address so that we know who the inquiry is from and can respond to it. The provision of additional data is not required and is otherwise on a voluntary basis on your part. Data processing for the purpose of contacting us or through us is carried out according to Art. 6 Para. 1 Clause 1 lit. a GDPR based on your voluntarily given consent. The personal data collected by us for the use of the contact form or callback form will be automatically deleted after completion of the request made by you.

2.3. WHEN SIGNING UP FOR OUR NEWSLETTER

If you have expressly consented according to Art. 6 Para. 1 Clause 1 lit. a GDPR, we will use your email address to regularly send our newsletter for press releases, ad-hoc announcements, financial figures, or even event invitations. Providing an email address is sufficient for receiving the newsletter. Unsubscription is possible at any time and can be done via email at ir@xlifesciences.ch. Advertising for products does not occur, nor is there a transfer of data to third parties.

3. DISCLOSURE OF DATA

A transmission of your personal data to third parties for purposes other than those listed below does not occur. We only pass on your personal data to third parties if:

  • You have given your express consent to this according to Art. 6 Para. 1 Clause 1 lit. a GDPR,
  • this is legally permissible and according to Art. 6 Para. 1 Clause 1 lit. b GDPR necessary for the handling of contractual relationships with you (e.g., postal/parcel services, handling of payments),
  • and in the case that there is a legal obligation for disclosure according to Art. 6 Para. 1 Clause 1 lit. c GDPR or
  • the disclosure according to Art. 6 Para. 1 Clause 1 lit. f GDPR is necessary to assert, exercise, or defend legal claims, even against contractual partners, or for the constant analysis and improvement of our offer as well as maintaining the attractiveness of our offer is required (e.g., maintenance of customer lists, analysis of databases, advertising measures, offering modern technical solutions), and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data.

In so far as we use the services of third parties as processors in the sense of the GDPR for our processing processes, we maintain the necessary contractual relationships with them in accordance with Art. 28 GDPR. A transfer of data to third parties in countries outside the EU (third countries) only takes place if and insofar as you have consented to this or if there is a legitimate overriding interest on our part. If such data is transferred, we contractually ensure that the processors there comply with a level of data protection that corresponds to that of the European Union.

4. RIGHTS OF THE DATA SUBJECT

You have the right to request information about your personal data processed by us:

  • in accordance with Art. 15 GDPR. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to complain, the origin of your data, if these were not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about their details;
  • in accordance with Art. 16 GDPR to demand the immediate correction or completion of your personal data stored with us;
  • in accordance with Art. 17 GDPR to request the deletion of your personal data stored with us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
  • in accordance with Art. 18 GDPR to request the restriction of the processing of your personal data, as far as the accuracy of the data is disputed by you, the processing is unlawful, but you reject their deletion and we no longer need the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing;
  • in accordance with Art. 21 GDPR; in accordance with Art. 20 GDPR to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
  • in accordance with Art. 7 Para. 3 GDPR to revoke your once given consent to us at any time. This has the consequence that we may not continue the data processing based on this consent for the future;
  • in accordance with Art. 77 GDPR to complain to a supervisory authority. Usually, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this.

5. RIGHT TO OBJECT

If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided there are reasons for this that arise from your particular situation or if the objection is directed against direct advertising. In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation. 6. DATA SECURITY

During the website visit, we use the widespread SSL method (Secure Socket Layer) in connection with the highest encryption level supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can recognize whether a single page of our internet presence is transmitted encrypted by the closed display of the key or lock symbol in the lower status bar of your browser. Furthermore, we use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorized access by third parties (e.g., firewall system). Our security measures are continuously improved according to technological development.

7. Changes to this privacy policy

This privacy policy is currently valid and has the status of January 2024. Due to the further development of our website and offers about it or due to changed legal or regulatory requirements, it may become necessary to change this privacy policy.
